1Acceptance of Terms
PLEASE READ THESE TERMS CAREFULLY. By creating an account, purchasing, downloading, or using any digital asset, template, or software (collectively, the "Products") from BunBy.app ("Service", "we", "us", "our"), you ("User", "Buyer") agree to be bound by these Terms of Service ("Agreement").
If you do not agree to these terms, you are strictly prohibited from using our Service. This Agreement constitutes a legally binding contract between you and BunBy.app.
2Nature of Products & Intellectual Property
2.1 Ownership vs. License
You acknowledge that by purchasing a Product, you are NOT acquiring ownership of the source code, design, or intellectual property. You are acquiring a limited, non-exclusive, revocable license to use the Product in accordance with specific usage rights.
BunBy.app retains all ownership, copyright, and other intellectual property rights to the unique compilation, arrangement, and design of the Products, including any AI-assisted or open-source components contained therein.
2.2 AI & Open Source Disclaimer
Our Products may contain code generated by Artificial Intelligence (AI) or third-party open-source components (e.g., MIT Licensed libraries).
- AI Components: You acknowledge that parts of the code may be AI-generated. BunBy claims copyright over the human-curated structure, compilation, and modifications of such code.
- Open Source: Any open-source components included are subject to their respective original licenses.
3License Terms (Strict Usage Rights)
We grant you a specific license based on your purchase. Unless explicitly stated otherwise in a specific product description, the Standard Commercial License applies:
3.1 What You CAN Do (Standard License)
- Personal Use: You may use the Product for your own personal projects or website.
- Client Use: You may use the Product for one (1) single end-product for a client.
- Modification: You may modify, combine, and customize the code to fit your needs.
3.2 What You CANNOT Do (Strict Prohibitions)
⚠️ VIOLATION OF THESE POINTS WILL RESULT IN IMMEDIATE LEGAL ACTION AND LICENSE TERMINATION.
- NO RESALE: You are strictly prohibited from reselling, redistributing, sub-licensing, or sharing the source code.
- NO "SaaS" TEMPLATES: You cannot use our Product to build a "Website Builder" or "Theme Generator" application.
- NO PUBLIC REPOS: You may not host the source code in a public repository.
- NO ASSET STRIPPING: You may not extract specific components and sell them as standalone assets.
4Payments & Refund Policy
4.1 All Sales Final
Due to the digital nature of our Products (source code), which cannot be "returned" once downloaded, ALL SALES ARE FINAL.
We do NOT offer refunds for:
- "Change of mind."
- Lack of technical expertise to use the Product.
- Incompatibility with 3rd party plugins or future software versions.
- Accidental purchases.
4.2 Limited Exception
We may, at our sole discretion, offer a refund ONLY if:
- The Product is technically defective (corrupt file, missing core files).
- AND you have contacted Support, and we were unable to resolve the issue within 7 business days.
5Disclaimer of Warranties ("AS-IS")
THE SERVICE AND PRODUCTS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNBY.APP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
- No Guarantee of Profit: We do not guarantee that using our templates will result in sales, traffic, or business success.
- No Bug-Free Guarantee: Software is inherently complex. We do not warrant that our code is 100% error-free.
- Security: While we strive for security, we do not warrant that our Products are immune to hacking or malware.
6Limitation of Liability
⚠️ READ THIS CAREFULLY. THIS LIMITS OUR FINANCIAL LIABILITY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUNBY.APP, ITS OWNERS, AFFILIATES, OR EMPLOYEES BE LIABLE FOR:
- Indirect Damages: Loss of profit, revenue, data, goodwill, or business interruption.
- Third-Party Claims: Any legal claims made against you by third parties arising from your use of our Products.
- Total Cap: Our total cumulative liability shall NEVER EXCEED THE AMOUNT YOU PAID for the specific Product giving rise to the claim. For free products, liability is capped at $0.00.
7Indemnification
You agree to defend, indemnify, and hold harmless BunBy.app and its officers from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of:
- Your use or misuse of our Products.
- Your violation of this Agreement.
- Your modification of our code that results in a security breach or legal issue for a third party.
8Account Termination
We reserve the right to suspend or terminate your account and revoke your licenses immediately, without notice or refund, if we suspect:
- You have shared our premium files on "Warez" or pirate sites.
- You are reselling our templates on other marketplaces.
- You have attempted to hack or exploit our website.
9Governing Law & Dispute Resolution
9.1 Jurisdiction
These Terms shall be governed by the laws of Pakistan.
9.2 Exclusive Venue
Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of Rawalpindi/Islamabad, Pakistan. You waive any objections to jurisdiction.
9.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
10Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
